- How do we get this? We collect this directly from you, either through your use of the Service or interactions with VICI over social media. The only Protected Characteristics we will collect are age (to verify you are old enough to make an account) and gender. We receive these characteristics directly from you, as well as through third parties like outbound marketing vendors and others where you may have made an account.
- Why do we need to know this? To verify you can make an account under our Terms and Conditions and to improve your customer experience.
Personal Characteristics protected under California Customer Records statute (Cal. Civ. Code § 1798.80(e)): This includes things like your name, signature, physical characteristics or description, address, social security number, telephone number, credit card number, debit card number, or any other financial information. Some personal information included in this category may overlap with other categories.
- How do we get this? Directly from you through your use of the Service, interactions with VICI over social media, as well as through third parties like outbound marketing vendors and others
- Why do we need to know this? To communicate with our customers, fulfill the purposes of the Service, marketing to you informing you of our new products, services and offers, providing you targeted advertising, running promotions and sweepstakes, provide you with access to a loyalty program, provide you information about VICI, complete transactions with our customers and improve your customer experience. Social Security numbers are only collected for prize winners under any sweepstakes. This is used to file tax documents associated with the distribution of any prize to the prize winners.
Commercial Information: This includes things like purchase and return data, information you share with our customer service, including our artificial intelligence-powered chatbot, survey responses, feedback, choices you make with respect to communications we sent to you or how we use your data, account program information, and size, fit and product preferences. Some personal information included in this category may overlap with other categories.
- How do we get this? Directly from you, as well as through third parties like our vendors that assist with our sales and marketing.

Sensory Data: This includes things like audio, electronic, visual or other similar information.

Directly from you through your interactions with the Service and social media pages owned or run by VICI, as well as through third parties like outbound marketing vendors and others. - Why do we need to know this? To communicate with our customers, fulfill the purposes of the Service, display your reviews of our products, improve your customer experience, and better develop the Service and our products.
Internet/Electronic Activity: This includes things like your browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.

- Why do we need to know this? II. HOW LONG DO WE TYPICALLY RETAIN INFORMATION?
While it may differ depending on your relationship with us and your use of the Service, we will typically retain your information for the duration of our business relationship, unless we are instructed by you to delete your information, or we are otherwise required to delete your information under law. Nonetheless, some information may be deleted from our servers when they no longer become relevant to your continued relationship with us, for example, you delete your registered account for our Service.
VICI reserves the rights to retain information as necessary to improve the Service, respond to legal requests or comply with other legal or commercial requirements. You may have the opportunity to opt-out of certain communications and modify any demographic information you've provided. Upon an event requiring deletion of your account data under law, VICI deletes all the above-mentioned data in its possession within a reasonable timeframe. VICI does not verify the correctness of personal data.
In some cases, we may not be able to delete your personal information, and will retain and use your information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and comply with technical and legal requirements and constraints related to the security, integrity and operation of the Service. We take reasonable steps and appropriate measures to protect data from loss, misuse, unauthorized access, disclosure, alteration, and destruction.
III. WHY WOULD VICI SHARE MY INFORMATION?
There may be times we need to share your information. For instance, we may share personal information with parties to business transactions such as those we deal with in mergers, acquisitions, joint ventures, sales of assets, reorganizations, divestitures, dissolutions, bankruptcies, liquidations, or other types of business transactions. For instance, VICI utilizes third party vendors, service providers, contractors, or other third parties to provide you different aspects of the service or address issues on the service. These parties will have to be provided your personal information as described below. For instance, if you purchase an item on the service, a service provider will be needed to assist in processing your payment, and a third party vendor may similarly be utilized when you leave online reviews on the service, or a contractor to automatically issue you gift cards or rewards for your purchases.
Other third party vendors, service providers, contractors, or other third parties may need your usage data to prevent fraud, confirm transactions, or otherwise address technological issues on the service.
Finally, VICI may utilize third parties (like outside marketing vendors), to assist VICI in its marketing efforts, and may be required to distribute your information to the marketing provider providing the service.
In any case, VICI shall endeavor to ensure that each third party vendor, service provider, contractor or other third party receiving your information is bound to secure your information to the same extent VICI would, and that such parties use reasonable security measures for your benefit.

You may have certain rights under state laws as we describe below. VICI respects its consumers privacy rights, and will assist its consumers to enforce those rights according to the provisions below:
A. NOTICE TO CALIFORNIA RESIDENTS
California Residents: Your Request Rights
If you are a California resident, you should be aware that you have certain special rights regarding your information and may request the following.
- If you are a California resident, you may request that we disclose the following:
- The categories of personal information it has collected about that consumer.
- The categories of sources from which the personal information is collected.
- The business or commercial purpose for collecting, selling, or sharing personal information.

How We Use Personal Data
We use the Personal Data we collect for the following purposes:

V. IS THERE ANYTHING ELSE I NEED TO KNOW ABOUT MY PRIVACY RIGHTS?
A. VICI Bucks and Notice of Financial Incentive.
We provide special offers to our customers via our VICI Bucks program, where, on occasion and if your order meets the minimum requirements, we may submit an e-gift card to you through the email you used to make your purchase. There is also the VICI Social Club Program, which may also offer you gift cards and discounts from time to time, associated through the email you used to make your account. Participation in these program are not essential, but we will need to have your email on file (and account information for the VICI Social Club Program) in order to submit the gift cards and discounts to you. Please note that if you delete your account or otherwise request the deletion of your personal information, you may not be able to participate in these programs.
While we do not assign a monetary value to the personal information we collect as part of our promotions, we do receive value in the form of customer loyalty and increased purchase engagement. Considering this value to VICI, we considered the revenue generated, continued purchases from our customers, less expenses associated with the promotions and benefits offered. This value varies by member depending on the purchases made, and how those purchases are made (in person or online).
B. Children
Our Services are not directed to children, and we do not knowingly collect Personal Information from children under the age of 16. If you learn that a child has provided us with Personal Information, then you may contact us as indicated above.
C. Do Not Track Signals
VICI does not currently take steps to respond to browsers' "Do Not Track" signals as no uniform standard to respond to such signals has been developed at this time.
D. Opting Out of Text Marketing and Notifications
By entering your phone number in at checkout and initiating a purchase, subscribing via our subscription form or a keyword, you agree that we may send you SMS and mobile text messages relating to your order, abandoned cart reminders, product returns and text marketing offers. The number of text messages will vary and no purchase is necessary. You acknowledge that consent is not a condition for any purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us. You may also opt-out by sending a request via email to privacy@vicicollection.com with the phone number you wish to opt-out.

Note that if you unsubscribe from receiving text marketing messages, we may still send you transactional text messages about your account or any services you have requested or receive from us (e.g., account verification, technical and security notices, purchase-related communications).
E. Opting Out of Direct Mail Marketing
We may reach out to you for direct marketing, but we only want to reach out to you if you want to hear from us. If you don't want to receive direct marketing from us, or any of our vendors, partners, or opt out of our rental or exchange of your information with other marketers, please let us know. Please note that if you want to remove or update your contact information, it may take approximately five days after an email request, and 6-8 weeks after any postal request.
